Terms and Conditions

These Terms and Conditions govern the use of financial services provided by Mulligan Finance Limited, a licensed financial services provider operating under the laws of the Federal Republic of Nigeria. By using the Mulligan mobile application or any of our services, you agree to the following terms, which constitute a legally binding agreement between you and Mulligan Finance.

By registering for an account or using our app, you accept and agree to comply with the following:

We may update these terms from time to time. Any changes that affect your rights will be communicated with a minimum of 21 days' notice. Continued use of our services after updates means you agree to the modified terms. If you do not agree, kindly exit the application and discontinue usage.

We reserve the right to suspend or terminate your access if you violate these terms, with prior notice of 21 days.

1.0 Definitions

1.1 Account –A virtual account created on the Mulligan platform that stores your transaction history, loan balances, and repayment activities.
1.2 Agent –Any authorized representative or channel used to deliver Mulligan services.
1.3 BVN –Bank Verification Number issued by Nigerian banks and used for identity verification.
1.4 CBN –Central Bank of Nigeria, the main regulatory authority.
1.5 Content –Any material (text, video, audio) made available via the Mulligan platform.
1.6 Credit –Inflow of money into your Mulligan account.
1.7 Debit –Outflow of money from your Mulligan account.
1.8 Customer Tiers –Classification of users (e.g., Basic, Intermediate, Advanced) based on KYC requirements.
1.9 Linked Account –A bank account or card connected to your Mulligan wallet for transactions.
1.10 Merchant –Businesses or individuals who accept Mulligan as a payment method.
1.11 Mobile Payments –Transactions made using mobile devices through Mulligan's platform.
1.12 Mobile Phone –A GSM device used to access the Mulligan app and receive transaction alerts.
1.13 OTP –One-Time Password used to authorize sensitive transactions.
1.14 PIN –A Personal Identification Number used to secure your account.
1.15 Products –Loan offerings and financial services by Mulligan (e.g., Payday Loans, Salary Loans, BNPL, etc.).
1.16 Registered Number –Phone number associated with your Mulligan account.
1.17 Services –All digital financial solutions provided via the Mulligan platform.
1.18 Wallet –A digital store of value within the Mulligan app where your transactions are processed.
1.19 SMS –Short Message Service used to communicate transaction alerts.
1.20 Loan –The amount borrowed from Mulligan, including interest and applicable fees.
1.21 Credit Reference Bureau –An agency that provides credit history and performance records.

2.0 Interpretation

  • 2.1 Words in the singular include the plural and vice versa.
  • 2.2 References to any gender include all other genders.
  • 2.3 Headings are for reference only and do not affect interpretation.
  • 2.4 The recitals and appendices are part of this agreement.
  • 2.5 Terms such as "you," "your," "borrower," or "customer" refer to the user of Mulligan services, while "we," "us," "our," or "Mulligan" refers to Mulligan Finance Limited.

4.0 Eligibility and Registration

To use Mulligan's services, you must:

  • Be at least 18 years old
  • Possess a valid BVN
  • Have an active Nigerian phone number
  • Complete the KYC process as required by regulations

5.0 Consent to Electronic Communications

By using the app, you agree to receive all communications (including loan offers, receipts, and legal notices) electronically. These may be sent via SMS, email, or in-app notifications.

6.0 Loan Terms and Repayment

  • Loan amounts, interest rates, and repayment schedules will be communicated during the application.
  • Loans must be repaid by the agreed due date to avoid penalties.
  • Repayments are deducted via your linked card or bank account.
  • Defaulting may lead to suspension of your account or reporting to credit bureaus.

7.0 Security and Access

  • Keep your login details and PIN confidential.
  • Mulligan will never ask for your PIN via call, SMS, or email.
  • Notify us immediately if you suspect any unauthorized access.

8.0 Data Privacy

All user data is handled according to our Privacy Policy. We will not share your information with third parties without your consent, except as required by law or for loan processing purposes.

9.0 Fees and Charges

  • Applicable fees (processing, interest, late payment, etc.) will be clearly shown before you finalize a loan.
  • There are no hidden charges.

10.0 Changes to Terms

We may revise these terms periodically. Changes that reduce your rights or increase your obligations will be communicated in advance (minimum of 21 days). Continued use of our platform implies your acceptance.

11.0 Termination

Mulligan reserves the right to terminate this agreement and deactivate your account if any of the terms are violated. We will notify you 21 days prior to termination, except in cases involving fraud or illegal activity.

Part A: General Provisions

3.0 Grant and Scope of License

3.1 In consideration of your agreement to comply with these Terms and Conditions, Mulligan Finance Limited grants you a limited, non-transferable, and non-exclusive license to use the Mulligan mobile application ("the App") on your device. This license is strictly subject to your continued compliance with this Agreement. All other rights are reserved by us.

3.2 You agree not to lease, rent, sublicense, lend, modify, adapt, translate, or alter the App in any form.

3.3 You must not tamper with, alter, or combine the App with other software or allow it to be merged into another application or service.

3.4 You agree not to reverse-engineer, disassemble, decompile, or create derivative works from the App or any part of it, except as permitted by law for the sole purpose of achieving software interoperability — provided that:

3.5 Any information obtained during such processes is not shared with third parties or used to create similar software.

3.6 You may not distribute or share the App or its code (in whole or part) with others without our prior written consent. All copies of the App must display our copyright notice.

3.7 You are responsible for complying with all applicable laws, including technology export and control regulations, that govern the use of the App and related technologies.

4.0 Account Creation and Usage Requirements

4.1 To access Mulligan's services, you must first create an account via our mobile application. During registration, you will be required to agree to these Terms and our Privacy Policy. Additional terms may apply for specific services.

4.2 Only Nigerian citizens aged 18 years and above are eligible to open a Mulligan account. By proceeding, you confirm that you meet this requirement. We may request proof of age at any time.

4.3 You must provide accurate and complete information, including your full name, phone number, email address, BVN, and any other details we may request for verification and onboarding.

4.4 You are responsible for updating your personal details on your profile when changes occur. You must also notify us at least five working days before changing or closing any linked bank accounts.

4.5 By opening a Mulligan account, you confirm that doing so does not breach any laws or regulatory rules applicable to you. You also agree to indemnify us against any losses arising from such breaches.

4.6 By creating a Mulligan account, you consent to the collection, use, and processing of your personal data for service delivery, communication, and marketing purposes in accordance with our Privacy Policy.

4.7 Only add payment instruments (bank accounts, cards, etc.) to your Mulligan account if you are the legal owner of such instruments. Violating this rule may be treated as fraud.

5.0 Personal Information and Verification

5.1 In line with Know Your Customer (KYC) and Anti-Money Laundering (AML) standards, we may require any or all of the following:

  • • Full name
  • • Date of birth
  • • Bank Verification Number (BVN)
  • • Residential address
  • • Photograph
  • • Valid government-issued ID (National ID, Voter's Card, Passport, or Driver's License)
  • • Proof of address (e.g., utility bill, bank statement, affidavit not older than 3 months)
  • • Any other documents required for internal compliance or risk assessment

5.2 You confirm that all information and documents you provide are true, correct, and up-to-date. You also agree to notify us of any changes to such information.

5.3 You authorize Mulligan Finance to verify your details with official records or third-party sources, including but not limited to NIBSS, banks, and other financial service providers.

5.4 Verification may include but is not limited to your name, address, BVN, phone number, age, ID number, and other identity-related data.

5.5 You also consent to Mulligan Finance collecting and verifying data from your device (including SMS history, app usage, and third-party services), as necessary to provide our services. If you provide a guarantor, you confirm that you have obtained their consent to share their details and for them to act in that capacity.

5.6–5.13: Use of Personal Information and Data Authorization

5.6 You hereby give your consent for Mulligan Finance Limited to collect, verify, and utilize your personal and relevant data, to the extent deemed necessary for delivering and enhancing our services.

5.7 You authorize Mulligan Finance and its authorized partners to obtain, access, and validate your information from various third-party sources, including private and public databases. You also consent to the lawful sharing of this information by us or our third-party service providers.

5.8 You agree to indemnify and hold Mulligan Finance Limited and its partners harmless against any loss, liability, claim, or expense (including legal costs) that may arise due to the retrieval, use, or reliance on your personal or relevant data.

5.9 Mulligan Finance reserves the right to request additional information from you at any point. If such requested data is not provided within the timeframe communicated, Mulligan may decline or restrict access to your account or services.

5.10 You acknowledge that when Mulligan Finance or its partners access information from third-party systems on your behalf, we do so as your agent and not as a representative of the third-party source.

5.11 You agree to indemnify Mulligan Finance for any losses resulting from an erroneous transfer initiated from your account.

5.12 You authorize Mulligan Finance to debit your account if it is determined that funds received or held in your account were transferred in error or were obtained through fraudulent means.

5.13 For your safety, Mulligan Finance strongly advises that you do not disclose sensitive information such as your BVN, OTP, or account login credentials to anyone. Mulligan will not be held liable for any losses arising from such breaches due to negligence or compromise.

6.0 Transactions and Account Usage

6.1 You may access available funds in your Mulligan account at any time. Although we strive to provide seamless service, all services are provided "as is," without warranty of uninterrupted availability.

6.2 All financial transactions will be conducted in Nigerian currency — Naira (₦) and Kobo.

6.3 A receipt or confirmation will be provided for each transaction made from your account, which may be delivered via SMS, email, or other available channels.

6.4 Certain transactions may require the entry of your secure PIN. You are solely responsible for maintaining the confidentiality of your PIN and login details. You must take all necessary steps to safeguard your credentials against unauthorized use.

6.5 In line with regulations from the Central Bank of Nigeria (CBN), daily transaction and account limits may apply. These limits may be adjusted based on the level of documentation you provide and your KYC classification.

6.6 Any deposit made into your Mulligan account will reflect once the transaction is confirmed. Cleared funds will be made immediately available for use.

6.8 We reserve the right to verify all transactions and deposits. In case of discrepancies, our internal records shall serve as the final reference unless proven otherwise.

Risk Controls and Compliance

6.10 Please note that certain transaction types or payment channels may be subject to stricter limits than those prescribed by the Central Bank of Nigeria (CBN). This may be necessary based on risk assessments or fraud prevention measures.

6.11 By operating an account with Mulligan Finance Limited, you agree to comply at all times with Nigeria's anti-fraud and anti-money laundering regulations. You further agree to promptly respond to any request for information or documentation from Mulligan Finance or authorized regulatory and legal authorities in relation to your account usage or suspected activity.

6.12 Any breach of anti-money laundering or fraud-related laws will be considered a serious violation of these Terms and Conditions and may result in the immediate suspension or termination of your account.

6.13 Where we suspect a transaction to be related to fraud, criminal activity, or money laundering, Mulligan Finance reserves the right to withhold such funds pending further investigation or a directive from a court or regulatory body.

6.14 Mulligan Finance is committed to full compliance with the Money Laundering (Prohibition) Act 2011 (as amended) and all other applicable financial crime prevention laws.

7.0 Funding and Transfers

7.1 Upon registration, you will receive a dedicated bank account number. This account can receive funding through direct transfers, card payments, or loan disbursements from Mulligan Finance Limited, subject to applicable account and regulatory limits.

7.2 You can transfer funds from your Mulligan account to other Mulligan users or to any valid Nigerian bank account.

7.3 We reserve the right not to process a payment or transfer in the following circumstances:

  • 7.3.1 The instruction given is unclear or incomplete
  • 7.3.2 There are insufficient funds in your account
  • 7.3.3 The transaction is flagged for suspicious, illegal, or fraudulent activity
  • 7.3.4 There is suspected unauthorized access to your account
  • 7.3.5 Legal restrictions prevent us or our partners from completing the transaction
  • 7.3.6 The transaction exceeds your daily or tiered payment limit
  • 7.3.7 Your account has been dormant for more than 12 months
  • 7.3.8 The transaction would violate any Nigerian financial regulation or directive

7.4 You are solely responsible for entering the correct payment or recipient details. If a payment is made to the wrong account due to incorrect details provided by you, we will make reasonable efforts to assist in the recovery of the funds, provided you notify us quickly. However, we cannot guarantee that such funds will be recovered.

7.5 You may be required to authenticate transactions with a Personal Identification Number (PIN) or password. Once a transaction is confirmed with your credentials, it is deemed authorized.

7.6 Any negative balance in your account may be treated as a loan, and you agree that such amounts are immediately due and repayable to Mulligan Finance Limited.

8.0 Prohibited Transactions

8.1 You must not use your Mulligan account to send or receive payments related to:

  • • Illegal drugs, substances, or drug-related paraphernalia
  • • Firearms, ammunition, explosives, or weapons
  • • TV or satellite decryption devices
  • • Pornographic content or obscene materials
  • • Forged or replicated government IDs and licenses
  • • Counterfeit goods or unlicensed branded products
  • • Unauthorized or unregistered gambling and lottery activities
  • • Fake charities or unverified fundraising operations
  • • Stored-value cards that are not linked to legitimate merchants
  • • Pyramid schemes, Ponzi schemes, and other fraudulent financial programs
  • • Items or services that violate intellectual property laws
  • • Any transactions prohibited by the Central Bank of Nigeria (CBN) or applicable Nigerian law

8.2 You are strictly prohibited from making or receiving payments related to unlicensed gambling services, including sports betting, online casino platforms, or poker rooms. If we suspect your account is being used for such activities, we reserve the right to suspend or terminate your account immediately.

8.3 Any attempt to use your Mulligan account for fraud, scams, terrorism financing, or money laundering will be reported to law enforcement. Mulligan reserves the right to:

  • • Cancel or reverse such transactions
  • • Close or freeze your account
  • • Report the incident to relevant authorities
  • • Recover any financial losses or damages incurred
  • • Apply administrative penalties or service charges if applicable

Credit Facility Terms

These Terms and Conditions govern the provision of credit services by Mulligan Finance Limited ("Mulligan", "we", "our", or "us") to individuals ("you", "your", "borrower", or "customer") through our loan platform. By accessing or using Mulligan's loan services, you agree to the terms outlined in this Agreement.

How to Access a Mulligan Loan

Your Mulligan Loan Account allows you to access flexible or fixed-term loans that are repaid via direct debit, card repayment, or manual transfer. Interest may be charged at a flat daily rate of up to 1%, depending on the credit terms presented to you during the loan application.

8.4 Key Definitions

For the purpose of this Agreement:

"Account" –refers to your registered profile with Mulligan Finance Limited used to apply for and manage your loan(s).
"Disbursement Date" –is the date on which the loan amount is transferred to your designated account.
"Payment Due Date" –is the agreed date for the repayment of your loan or installment.
"Credit Limit" –means the maximum loan amount made available to you at any given time.
"Loan" –is the approved credit amount disbursed to you, starting from a minimum of ₦20,000 (Twenty Thousand Naira only).

8.5 Loan Charges and Fees

8.5.1 The applicable interest rate and all associated fees will be clearly displayed to you on the Mulligan platform prior to your acceptance of the loan.

8.5.2 If repayment is not made by the agreed due date, a penalty of 1% per month may be applied to the outstanding balance. For loans issued at 0% interest, a 1% charge will apply starting on the first day of default.

8.5.3 Mulligan reserves the right to modify interest rates or fees. Changes will be communicated at least 15 days in advance before taking effect on your account.

8.5.4 If you wish to repay your loan before the final due date, please contact us at hello@mulliganfinance.ng to determine any potential interest reduction for early settlement.

8.6 Borrower's Responsibilities

8.6.1 You agree to repay the total loan amount, including any applicable interest, transaction fees, penalties, and charges, in accordance with the repayment schedule.

8.6.2 Any loan application submitted using your Mulligan Account will be considered authorized unless you notify us in writing of potential fraud within 24 hours of discovery.

8.6.3 Loan repayments may be made through bank transfer, linked card debit, or other approved electronic channels.

8.6.4 Mulligan may accept early repayments provided you notify us in advance and settle both the outstanding principal and accrued interest.

Card Payment Terms

8.6.4.1 A one-time processing fee may apply when you first register a new debit card on your account. If your card expires, it is your responsibility to update it with a valid card.

8.6.4.2 We will only charge your registered card for scheduled loan repayments. If a double charge occurs by error, we will refund the excess amount within a reasonable timeframe.

8.6.4.3 You agree to indemnify us if you link or use someone else's card without their authorization.

8.6.4.4 In case of default or insufficient funds, you authorize Mulligan to attempt recovery from any other card linked to your account.

8.6.4.5 Card details are never stored on Mulligan's servers. All payment data is handled through certified payment gateways.

8.6.5 You agree to provide accurate and up-to-date personal, financial, and contact information upon request, including but not limited to your phone number, email, or social media contact details.

8.6.6 You agree to indemnify Mulligan Finance Limited and its affiliates or agents against any legal claims, losses, damages, or expenses (including legal fees) arising from:

  • 8.6.6.1 The issuance, management, or collection of your loan;
  • 8.6.6.2 Any breach of this agreement or loan-related documentation;
  • 8.6.6.3 Any claim or dispute related to your use of this credit facility, except where Mulligan is proven to be grossly negligent or engaged in misconduct, as determined by a court of competent jurisdiction.
  • 8.6.6.4 However, the Borrower shall not be held liable to indemnify any person or party if such claims, proceedings, or losses are proven to arise solely from that party's gross negligence or intentional misconduct, as confirmed by a court of competent jurisdiction.

8.7 Borrower's Additional Covenants

You agree to the following commitments as part of this Agreement:

8.7.1 Not to provide any false or misleading information, documentation, or electronic signatures during the application or throughout the duration of the loan.

8.7.2 To pay any late payment charges or penalties in line with the terms outlined in this Agreement.

8.7.3 To make all repayments using your authorized debit card or via electronic bank transfers, as stated in your approved loan agreement.

8.7.4 To promptly notify Mulligan Finance Limited in writing if there is a change to your name, residential or mailing address, phone number, or email address.

8.7.5 To fulfill all obligations and promises made under this Agreement.

8.7.6 Not to apply for or accept this credit facility unless you are legally competent and of full legal age.

8.7.7 Not to use the Mulligan Finance platform or services for any illegal or criminal activity. Mulligan Finance Limited shall not be held liable for any criminal acts committed by you.

8.7.8 To grant Mulligan Finance Limited the right to initiate early recovery and deduct full repayment from your account(s) if it is discovered that the loan was obtained through fraudulent means.

8.7.9 To complete the loan application form truthfully and provide all requested information accurately.

8.8 Lender's Responsibilities

Mulligan Finance Limited undertakes to:

8.8.1 Provide approved loan amounts to eligible customers, starting from a minimum of ₦20,000 (Twenty Thousand Naira only).

8.8.2 Disburse the loan after confirming your identity and verifying your information.

8.8.3 Monitor repayment timelines and issue demand notices when payments become due.

8.8.4 Carry out necessary credit and background checks before opening a loan account or disbursing funds.

8.8.5 Use all lawful and appropriate channels to recover overdue loan amounts, including applicable fees and penalties.

8.8.6 Never store or retain your card details on our platform. All payment card processing is handled through secure compliant gateways.

8.9 Credit Reporting & Verification

8.9.1 Mulligan Finance Limited, or its appointed agents, reserves the right to request your credit history from licensed Credit Bureaus when reviewing your application.

8.9.2 By accepting this Agreement, you authorize Mulligan to access any credit information held about you and to report the status of your loan (excluding card details) to relevant credit reporting agencies.

8.10 Communications and Notifications

8.10.1 You agree that we may contact you with information about your account, repayments, or this Agreement using any of the following methods:

  • 8.10.1.1 By sending written correspondence to your last known physical address.
  • 8.10.1.2 By emailing you at the address you provided during registration.
  • 8.10.1.3 By sending SMS messages to your registered phone number.
  • 8.10.1.4 By publishing updates or notices on our official website at www.mulliganfinance.ng.

8.11 Default and Legal Remedies

You will be considered in default of this Agreement if:

  • 8.11.1 You fail to repay your loan in full by the agreed Payment Due Date, as outlined in your repayment schedule.
  • 8.11.2 Any information or declaration you submitted during the loan process is later found to be materially inaccurate or deceptive.
  • 8.11.3 You take any action that risks or harms Mulligan's ability to recover the loan, or causes any financial loss to Mulligan.

Consequences of Default

If a default event as defined in Section 8.11 occurs:

8.11.4.1 Mulligan Finance Limited may assign its rights under this Agreement to a licensed collections partner or debt recovery agent, who may pursue recovery by all reasonable and lawful means.

8.11.4.2 We also reserve the right to initiate legal proceedings without prior notice, where necessary, to enforce repayment.

8.11.4.3 You agree to indemnify and hold harmless Mulligan Finance Limited, and any of its employees or partners, against any claims or losses (including reasonable legal fees and court costs) resulting from:

  • 8.11.4.3.1 Any breach of this loan agreement or failure to repay credit that was extended, suspended, or terminated.
  • 8.11.4.3.2 Misuse of loan services or misrepresentation of your personal or financial details.
  • 8.11.4.3.3 Any legal or financial dispute involving parties to this agreement.
Limitation of Indemnity

The Borrower shall not be obligated to indemnify any Indemnified Party for any claim, loss, or liability that arises solely from that party's gross negligence or intentional misconduct, as determined by a final decision of a competent court.

9.0 Data Protection and Customer Consent

9.1 The processing of your personal data is governed by our Privacy Policy, which is available on our website. By accepting these Terms of Use, you also consent to the terms outlined in our Privacy Policy, Anti-Money Laundering Policy, and any other applicable policies displayed on our website. We recommend printing a copy of the Privacy Policy along with these Terms of Use for your records.

9.2 By default, you will receive email newsletters containing important information about new features, promotions, updates, and other services. By agreeing to these Terms of Use, you consent to receive such email communications. If you no longer wish to receive these newsletters, you can opt out at any time through your Mulligan Finance Account settings or by contacting our Customer Support team. Please note, however, that you cannot opt out of essential system notifications regarding account activity or critical updates.

9.3 When signing up for the Mulligan Finance app, you will be asked to provide personal details such as your name, email, gender, and date of birth. In certain cases, additional information may be requested to verify your identity or provide specific services.

9.4 You can update your personal information at any time by accessing your profile or contacting Customer Support. Some updates will take effect immediately, while others may require further verification.

9.5 In order to enhance security, we may collect technical information from your device, such as browser type, location, IP address, and the pages you visit when using the Mulligan Finance app.

9.6 If you grant permission, we may request access to your phone's contacts. However, we will only upload these contacts to our servers if you explicitly consent to it. Rest assured, we will never share your contacts with third parties.

9.7 The Mulligan Finance app may ask for permission to access the following features on your device:

  • Camera: To capture profile pictures or scan payment card details for easier transactions.
  • Photo Library: To select an image for your profile picture.
  • Fingerprint or Facial Recognition: To enable secure logins.

These permissions will only be requested the first time you use any of these features. You may manage or revoke these permissions at any time through your device's settings.

9.8 We are required to retain records of all transactions or payments you make via Mulligan Finance. This information will only be shared with third parties if mandated by law or to improve our services, under strict confidentiality agreements.

9.9 By agreeing to these Terms of Use, you acknowledge that your personal data, including recorded conversations with Customer Support, may be retained for up to five (5) years from the closure of your account for record-keeping and compliance purposes.

9.10 By accepting these Terms, you agree to receive electronic communications, including important documents, statements, and legal disclosures. These electronic communications have the same legal effect as if they were provided in physical form. You will be able to access, download, or print these documents at any time.

9.11 We implement secure technologies such as encryption and firewalls to protect your account data during transmission and storage. Additionally, we monitor account behavior for any suspicious activity and may restrict or suspend your account if we detect fraudulent use.

9.12 Our Privacy Policy governs the collection, use, and sharing of your personal information. We encourage you to review this policy periodically for any updates.

10.0 Anti-Money Laundering (AML) and Countering Financing of Terrorism (CFT)

10.1 In compliance with relevant Anti-Money Laundering (AML) laws, we may request additional information regarding any transactions conducted via your Mulligan Finance Account. This could include details of the recipient, the source of the funds, and the purpose of the transaction. You agree to provide truthful and complete information when requested.

10.2 We reserve the right to cancel any transactions, suspend your Account, or refuse to open an Account if you fail to provide the required information, or if the information you provide is found to be false or misleading.

10.3 For certain transactions, we or our third-party partners may be required to file AML or related reports with the appropriate regulators, which may include details of your personal information, transactions, and other account activities, without prior notice to you.

11.0 Termination and Suspension of Account

11.1 We may terminate your Mulligan Finance Account or any associated services by providing 21 days' notice if you breach any of the terms outlined in this Agreement.

11.2 You may choose to terminate your Mulligan Finance Account at any time by following the appropriate procedure in the app.

11.3 Upon termination, we will provide instructions on how to withdraw any remaining funds in your Account.

11.4 We may suspend or terminate your Account without notice if we believe there has been a violation of the terms of service or if we suspect illegal or fraudulent activity, including but not limited to money laundering, terrorism financing, or violation of applicable laws.

11.5 If we believe your account has been compromised or used fraudulently, we may suspend it. We will notify you either prior to the suspension or as soon as possible after, unless we are legally prohibited from doing so. Accounts that remain inactive for 12 consecutive months may also be terminated without notice.

12.0 Taxes

12.1 Any payments made by you for services provided under this Agreement are exclusive of taxes. You are responsible for paying any taxes that may apply, in addition to any fees.

12.2 We reserve the right to withhold amounts from your account if required by tax authorities or in accordance with legal obligations.

12.3 If any payment is subject to deduction or withholding taxes, you agree to pay additional amounts so that we receive the full payment due, without reduction.

13.0 Communication

13.1 You can contact Mulligan Finance by email at hello@mulliganfinance.com or through any contact details provided on our website. We will acknowledge receipt of your communication via email.

13.2 We may contact you through email, SMS, or notifications in the app to inform you of any important updates or issues with your account. Important communications may also be posted on our website.

14.0 Account Security

14.1 You are responsible for maintaining the confidentiality of your account login credentials. If you suspect unauthorized access to your account, you must inform us immediately and change your password and security settings.

14.2 We reserve the right to modify, reclaim, or remove any username deemed inappropriate or offensive at our discretion.

15.0 General Provisions

15.1 A partial exercise of any right or remedy under this Agreement does not prevent further exercise of that right or any other right.

15.2 A failure to exercise any right or delay in exercising a right under this Agreement shall not constitute a waiver of that right.

15.3 If any part of this Agreement is found to be invalid or unenforceable, the rest of the Agreement will remain in effect.

15.4 We may transfer or assign our rights and obligations under this Agreement to another party. You may not assign your rights without our prior consent.

16.0 Entire Agreement

16.1 These Terms, along with the Privacy Policy, constitute the entire agreement between you and Mulligan Finance. This supersedes all prior agreements or understandings, whether written or oral.

16.2 You acknowledge that you have not relied on any representations outside of these Terms and the Privacy Policy when entering into this Agreement.
